基于比例原则的PPP项目成功运行研究
Promoting a PPP project successfully research based on the principle of proportion

PPP项目的实施在中国和世界都是非常必要的,我国目前正在大力推行PPP项目。很多学者都从技术上研究了怎样促进PPP项目的成功运行,但是目前还没有学者从法律技术角度去分析。首先,文章从分析研究PPP项目成功的关键因素的文献开始,得出政府信用是最主要的问题;然后引入比例原则来解决政府信用问题,并分类提出比例原则下的技术方案;最后分析得出法律技术框架图来保证实际PPP项目的成功运行,解决政府信用这个关键因素。
The implementation of PPP projects in China and around the world is very necessary, and China is vigorously promoting the PPP project. Previous work were technically studied on how to promote the success of the PPP project operation, but there are no studies from a technical point of view to analyze law. First, this paper analyzed the key successful factors of the PPP project documents. It is concluded that the government credit is the main problem; Then, the proportion principle were introduced to solve the problem of government credit, and the technical solutions under the proportion principle by category were obtained; Finally, the legal technology frame was put forward to ensure the success of the PPP project actual operation and the key factors of government credit were solved
