医疗伦理损害责任相关伦理问题与对策探究
Ethical problems and countermeasures of medical ethics injure liability

医疗伦理损害责任旨在要求医疗机构及医务人员履行告知义务，尊重患者知情权、自主选择权及隐私 权。本文以《侵权责任法》中涉及的医疗伦理损害规定为视角，分析了医疗伦理损害中的告知义务、知情同意、 保密义务以及责任因果关系等伦理问题，同时针对这些伦理问题，建议进一步完善相关医疗伦理规范，完善医疗 保障制度以及加强医学伦理委员会功能，应是可行之策。
Medical ethics injure liability requires medical institutions and medical personnel to fulfill their informing obligations and respect the patient’s right to know, the right to choose independently and the right of privacy. Based on the provisions of medical ethics injure liability in the Tort Liability Law of our country, we analyzed the duty of disclosure, informed consent, confidentiality obligation and liability causality and other ethical issues involved in the medical ethics injure liability; meanwhile, we suggested some solutions to these ethical problems such as improving the relevant medical ethics laws, perfecting the medical security system and strengthening the function of the medical ethics committee
