我国人体器官买卖屡禁不止的原因及对策探析

随着我国医学技术的快速发展，人体器官移植技术在医疗领域的运用愈发成熟、广泛。这一技术在为广大患者带来福音的同时，也引发了如人体器官犯罪、非法器官买卖等诸多问题，挑战着医疗秩序、社会稳定和道德底线。早在2010年，我国《刑法修正案(八)》就已明确非法器官买卖这一罪名，但时隔多年，器官移植领域并未得到有效规范，相关案件层出不穷，情形不容乐观。本文对人体器官犯罪等问题进行了深入研究，分析此类案件屡禁不止的原因并提出合理的整治对策。
With the rapid development of medical technology in China, the application of organ transplantation techniquebecomes more and more mature and extensive in medical field. This technology offers a new treatment for patients, however,it also produces many problems like illegal selling or buying human organs, disorganizing medical order, social stability andchallenging the base line of moral. As early as 2010, Criminal Law Amendment Bill (Eighth) had formulated illegal organtrading to be a crime; however, many years later, the field of organ transplant has not been effectively regulated, with relatedcases emerging one after another. This article made a deep study on the problem of illegal organ trading and analyzed thecauses of failing to stop this kind of crimes as well as put forward some reasonable countermeasures
