基于可行性视角论医疗领域“医师黑名单”制度的构建
Establishment of “doctor blacklist” system in medicinefrom the perspective of feasibility

“黑名单”制度是指对个人或企业的违法违规行为进行的惩罚性信息强制披露制度。针对现阶段我国医疗领域医师不端行为广泛存在、医疗恶性事件频发而监管乏力的现状，引入“黑名单”制度具有适用性和价值性。但由于外部环境的制约和医疗卫生领域的特殊性，“医师黑名单”制度的推行仍面临许多亟待解决的问题。因此，“医师黑名单”制度的构建必须在充分认识各项困境和挑战的基础上，科学设计“医师黑名单”的纳入要件、管理模式、公开范围和方式，并形成制度立法建议，以期达到降低医疗信息不对称、促进医疗行业自律和保护患者权益的目的。
“Blacklist” system is a kind of mechanism which mandatorily discloses the information of a person orenterprise as a punishment for the illegal behaviors. Since the misconduct of doctors is rather common currently in Chinawhere the health administration aimed at the medical accidents is not sufficient, it is necessary to establish the “doctorblacklist” system. But due to the restriction of the external environment and the particularity of medical and health fields,the implementation of the “doctor blacklist” system is still faced with many problems to be solved. “Doctor blacklist”system must be constructed based on the full understanding of the difficulties and challenges, and the scientific design ofenrolling criteria, management mode, publication realm and methods. It must be made into rules or laws. Only in this way,can it be realized to reduce the medical information asymmetry, promote the self-discipline of medical service and protectthe rights and interests of patients
