区域法治的竞争性机理分析

社会构成在区域空间上的分化，与多区域单位中利益及其结群的多元性，构成了区域法治的多元性基础。分化是竞争的条件，而竞争是社会进化及法律进化的根本机理，竞争性因素的拓展既是政治理性萌生及发展的标志，也是经济进步及其法治得以确立的动因。作为人类智识成果的法律，根源上依赖于思想的竞争性创造与表达。从司法传统、代议制立法与竞争性表达的关联来看，复合、多元的规范秩序及贯彻其中的竞争性的架构及程序空间，都旨在既维护人类已有的智识规则，又在不断竞争性思索及验证中完善这一规则体系。
The differentiation of social structure in terms of regional space and the diversity of interests andin the formation of interest groups among multi regional units make diversity the foundation of regional rule oflaw. Differentiation is the condition of competition which is in turn the fundamental mechanism of social andlegal evolutions. The expansion of competitive factors is not only the symbol of initiation and developmentof political rationality， but also the motivation of economic progress and establishment of rule of law. Asthe result of the progression of human intelligence， law depends on the competitive creation of ideas and theexpression of these ideas. Viewed from the relevance between judicial tradition， representative legislation， andcompetitive expression， compound multiple normative order and the competition structure and procedure spacecarrying out this order both aim to maintain the existing rules of human knowledge and improve this system ofrules in the process of continuous competitive thinking and verification
