基层治理法治化视野下的权力清单制度——基于上海市两个街道的实证研究

在治理法治化的逻辑检视下,基层政府权力清单制度的推行要实现权力配置及运行可视化、权力监督社会化的任务与价值。从权力的生成逻辑上看,基层政府权力清单制度的推行是立法机关、基层政府、基层群众自治组织、社区居民以及其他社会利益主体积极互动的过程;清单内容应体现基层政府内部“条”“块”、街镇政府与市场和社会主体等的权力和责任关系。对上海市两个街道实践的解析表明,基层政府权力清单制度存在着推行路径内部化、任务化与封闭化,清单内容片面化,权力依据随意化等程序性和结构性困境。究其原因,不仅在于实践环境的复杂性,也在于权力清单制度设计中蕴含的行政权力界定、法治型权威彰显和监督机制衔接等难题。
Abstract：The nature of grassroots governance under the rule of law ask the Power-list System in community-lever governments to undertake the mission that make administrative power's allocation and operation transparent and achieve socialization of power's supervision. Necessarily, the implantation of community-lever power-list system should be positive interaction among the legislature, city or district governments, town governments, the organization of community-lever self-governance, community residents and other social subjects. The contents of power and responsibility lists should involve the power and responsibility relations about “tiao” and “kuai” in community-lever governments, town governments and market and social subjects. The analyses of two sub-district offices testify that the practices of the Power-list System in community-lever governments are facing some procedural and structural problems. Not only because of the complexity of the practice environment, but the more important is the internal puzzles of the institute design, such as the definition of administrative power, the emergence of authority of the rule of law, and the connection of the supervision mechanism.
