Abstract:

在关于住宅建筑用地使用权续期问题的讨论中,续期问题的关键在于续期是否有偿或收费,这一问题的背后隐含着我国复杂地权模式在面临土地的“全民所有”和“个人使用”之间产生的矛盾。土地使用权自动续期是否无偿的争论大多会诉诸于土地权利和制度的社会主义解读,但却陷入一种无法解决的悖论。土地使用权续期费用的争论容易陷入社会主义悖论的原因和我国独特的土地财产权(地权)制度密切相关。从“配得”和“所有”的意义上理解土地财产权具有很强的解释力,可以让我们走出公私对立和国家与个人对立的模式,建构符合社会主义价值理念的土地续期逻辑。首先,我们需要在“配得”与“所有”的意义上重新理解土地公有制和土地财产权。其次,“配得”意义上的土地财产权决定了“所有”意义上的土地财产权必定需要有偿续期。最后,“配得”意义上的土地财产权也决定了有偿续期的基本方式。
In the discussion on the renewal of the usage rights of residential construction land, the key to renewal is whether the renewal is free or charging, and this problem implies the contradiction between the “state-owned” and “individual use”of land in our country. The discussion on whether the automatic renewal of the right to use land is free, mostly resorted to socialist interpretation of land rights andinstitutions, but this often resulted in an unsolvable paradox. The reason why the discussion on the renewal fees is easy to fall into the socialist paradox is closely related to our unique land property right (land right) institutions. Understanding the land property right in the sense of “one’s due”and “one’s own”has a strong explanatory power, so we can get out of the opposition between the public and the private and between the state and the individual, and construct the land renewal logic conforming to socialist values. Firstly, we need to re-understand the land public ownership and land property rights in the sense of “one’s due”and “one’s own”. Secondly, the land property right in the sense of “one’s due” determines that the land property right in the sense of “one’s due” must be paid for renewal. Finally, the land property right in the sense of “one’s due” also determines the basic way of the pay for renewal.
