刑事司法解释中的证明简化对控辩平等原则的冲击 ――兼论司法解释制度的完善及其与案例指导制度的功能划分与衔接

刑事司法解释在解释立法、统一法律适用的同时创设了一批旨在指导个案事实认定的抽象规则。刑事司法解释中的事实认定规则客观上导致了“证明简化”的后果，对控辩平等原则造成冲击，因而其正当性存疑。刑事司法解释中的证明简化对控辩平等原则的冲击是当前司法解释运行实践偏离该制度功能定位的典型反映。为协调解释立法与指导个案之间的关系，应当进一步完善司法解释制度，并使其与案例指导制度形成功能上的划分与衔接。
Criminal judicial interpretation created a number of abstract rules designed to guide the fact-finding in individual cases when playing its role of interpreting statutes and uniforming application of laws. These rules simplify the proof of cases, reduce the points of dispute, compress the defense space of the accused, increase the difficulty of cross-examination by the defense and profoundly influence the equality between prosecution and defense. In order to coordinate the relationships between the legislation and the guiding case, the judicial interpretation system should been further improved and forms a complementary relationship with the system of case guiding.
