社团立法的考察与反思 ――从《社会团体登记管理条例》（修订草案征求意见稿）出发

在贯彻“四个全面”战略布局的新时期，迫切需要社会团体等社会组织发挥其重要功能。然而，当下的社团立法，则采取了管制主义的路径，进行渐进审慎的赋权。尽管这一策略能够保持政府的控制能力和可靠秩序，但却难以通过有效的制度供给和法律环境来塑造社会团体的能力，也使其难以更好地为推进法治社会建设提供动力和支撑。因此，我们需要在“双强构架”的“中国模式”基础上，确立“共建共享”的社团立法导向，促进社会治理法治化。
In the new time of implementing “the four-pronged comprehensive strategy”, exerting the important functions of the social organizations and other social associations is demanded urgently. The current legislation of social organization, however, is presented as the “regulating and controlling approach”, that is, entitling the right progressively and deliberately. Even though the controlling capacity of government and the stable social order can be guaranteed by this approach, it could not construct the ability of social organizations well via effectively providing the institutional supply and legal conditions, so that the social organizations would not be the impetus and brace of the construction of society with rule of law as expected. Therefore, we need establish the “co-construction and sharing mode” as the guidance for legislation of social organization to improve the legalization of social governance, which is based on the “Chinese model” of “powerful state - powerful society framework”.
