论中国人权文化的正当性根基

中国已抵达文明转型的临界点，人们的行为方式、社会的价值取向乃至国家的制度与政策选择进入波动调整期，对人权文化与中国传统关系予以重新反思是非常必要的。在思想体系层面上，中国传统与人权文化是冲突的；在制度法统意义上，其与人权文化是对立的。对传统文化的重拾与重建，应限于共同体情感凝聚、国家文化认同和社会道德建设领域；超越此领域，就会造成对人权文化建设的破坏。从自然―社会人性和发自同理心的共同道德出发，完全可以确立中国人权文化建设的出发点和正当性根基，既无需照搬西方，亦无需求援传统。
Nowadays, China has arrived at the tipping point of civilization transition, where the way of people？？s behavior, the value orientation of the society and the system and policy choice of the country enter the period of fluctuation adjustment. So, it is very necessary to reconsider the relationship between human rights culture and Chinese tradition. On the ideological level, Chinese tradition is conflict with human rights culture. On the institutional and legal system, China tradition is opposite to human rights culture. Therefore, in the process of restoring Chinese traditional culture, if people go beyond the intention and boundary of building cultural confidence and spiritual home for the community, the construction of human rights culture will be destroyed. In fact, the foundations of Chinese human rights culture can surely be found in the natural-social humanity and common morality, which is based on empathy. In short, neither western tradition nor Chinese tradition is needed for the construction of Chinese human rights culture.
