论司法裁判中的目的解释

目前学术界重点讨论的目的解释的主客观对立理论并不能解决司法中的实际问题，因此应当采取更务实的分段研究，将目的解释的过程分为“目的获取”与“目的运用”两个阶段。在目的获取阶段，应采取德国学者提出的“限制性目的论视角”，即强调目的解释与其他解释标准的牵连性，并通过司法裁判实践探求这种关系的实际内容。在目的的运用阶段，必须防止目的的外在性问题，追求目的的内在的、具体的运用。
At present,the objective and subjective opposite theory of teleological interpretation which is emphatically discussed in the academic circle fails to solve the practical problems in the judiciary.Therefore,the more pragmatic segmental research shall be adopted to categorize the process of teleological interpretation into two stages,including“purpose obtainment”and“purpose application”.In the stage of purpose obtainment,it is required to take the so-called“perspective of the restrictive teleology”from German scholars,which is to emphasize the connection between teleological interpretation and other explanatory standards,and to explore the actual content of the relationship through judicial practice.In the application stage of the purpose,we must prevent the externality of the purpose and pursue the intrinsic and concrete application of the purpose.
