行为法律经济学视野中的“法律确定性命题”――以规则和标准的分类为线索Keywords: 不确定性, 最优精确度, 规则, 标准, 行为法律经济学Uncertainty, Optimal Accuracy, Rule, Standard, Behavioral Law and Economics Abstract: 传统法律经济学将“法律确定性命题”浓缩为规则和标准的分类问题,对应于法律实施的目标,在何种情况下采用相对精确的规则及相对模糊的标准就成了在“成本―收益”的分析框架之下可选择的事项。在借鉴心理学对过去的不确定性和未来的不确定性区分的基础上,行为法律经济学进一步推进了传统法理学和传统法律经济学关于“法律确定性命题”的讨论。不仅为规则和标准的各自适用条件寻找心理学依据,作出系统性调整,而且为法律决策者利用法律不确定性来改善法律决策和提高法律实施效果提供了可能。The“legal certainty proposition”is condensed into the classification of rules and standards in traditional economics of law. Corresponding to the objectives of the legal enforcement, when to use relatively accurate rules and relatively vague standards has become an option under the cost-benefit analysis framework. Based on the distinction between psychological uncertainty of the past and uncertainty of the future, behavioral law and economics promote the discussion of“legal certainty proposition”in traditional jurisprudence and traditional legal economics. This new academic path not only provides a psychological basis for the respective application of rules and standards, and helps to make systematic adjustments, but also makes it possible for legal decision makers to use legal uncertainty to improve legal decision-making andthe effectiveness of legal enforcement.
