如何理解“法理”？――法学理论角度的一个分析

法（理）学成为法（理）学的重要标志和基本方式是对其自身研究对象、方法及其限度的自觉和反思，对于法理学研究对象的自觉和反思，构成了“法理”概念提出的主要理论问题意识，也是其重要理论意义所在。既有法理学研究对象的理论模式存在未能区分法理学与法学其他科目的研究对象、不当限缩法理学研究对象和混淆法理学研究对象与其他相关问题等缺陷。“法理”概念具有丰富的内涵、广泛的论域、不同的层次和多重的维度，这使得“法理”具备了成为法理学研究对象和中心主题的理论基础，把“法理”界定为法理学研究对象的理论相较于既有理论模式具有更大的理论优势，有助于推进法理学成为真正的“法理”之学。
The consciousness and reflection of the objects, methods and limits of studying is an important sign and basic way that legal science(including jurisprudence) becomes a science. The principal purpose of construction of the concept of “Fali”is to understand and rethink of the objects of jurisprudence, and this is also the main theoretical meaning of “Fali”. The existing theories of the objects of jurisprudence do not distinguish jurisprudence and other legal subjects, or limit the objects of jurisprudence inappropriately, or confuse the problem of objects of jurisprudence with other problems. The concept of “Fali”has rich connotation, extensive fields, different levels and multiple dimensions. This makes “Fali”to possess the theoretical basis of becoming the object of study and the central theme of jurisprudence. The theory that “Fali” is defined as the object of study of jurisprudence has more theoretical advantages than the existing theoretical model. It is helpful to promote jurisprudence to become the real knowledge of “Fali”.
