新时代法理学教材的转型升级――《法理学》（第五版）教材修订纪实

在中国法学界，作为法理学研究对象之共识性“法理”概念尚未凝练，法理学应为“法理之学”亦未形成理论自觉，“法理”在法理学知识体系、理论体系、话语体系中处于缺席或半缺席状态。针对这种状态，由张文显教授主编、高等教育出版社编辑出版的《法理学》（第五版）守正创新，立足于中国特色社会主义新时代的历史方位和时代背景，在习近平新时代中国特色社会主义法治思想的引领下，致力于以法理为中心主题实现从法学基础理论到法理学的真正转型，以泛在的法理激活法理学知识体系和话语风格的焕然升级，用转型升级的高水平教材回应广大师生的新呼唤，可以说，这是中国特色社会主义法理学的一次具有里程碑意义的飞跃。
In Chinese legal academia, “Fali”, as the object of jurisprudence research, has not yet been developed into a well-recognized concept. Jurisprudence, as a discipline of Fali study, also lacks theoretical consciousness. “Fali” is by and large absent in the knowledge system, theoretical system, and discourse system of jurisprudence. In light of the situation, Jurisprudence (Fifth Edition), edited by Prof. Zhang Wenxian and published by the Higher Education Press, addresses the historical orientation and background of the new era of socialism with Chinese characteristics. Guided by Xi Jinping？？s thought of socialist rule of law with Chinese characteristics, the textbook centers on the theme of “Fali” to achieve the transformation from basic legal theories to Fali theories. The textbook uses the ubiquitous concept of Fali to activate the jurisprudence knowledge system and refresh the discourse style, and satisfies the demands of teachers and students with transformed and improved contents. The textbook is thus a milestone in the progress of socialist jurisprudence with Chinese characteristics.
