主体性时代的权利理论――改革开放以来中国权利理论的逻辑演进

自1980年代后期权利本位论出场算起，当代中国权利理论已经经历了30余年的发展，这一权利理论的发展有其内在的逻辑进程。权利理论的发展反映了时代精神的变迁。当代中国权利理论诞生在1980年代张扬个性的文化氛围中，在经济和社会的开放性发展中得到了社会物质层面的支持。当代中国权利理论的兴起与主体性哲学的兴起相伴随，也随着我们对于主体性的认知而逐步深化。纵观各个时期不同权利理论研究者的作品，可以看到，权利主体性在不同时期有不同的表达，权利从一个表达个体自由选择的概念，逐步发展为一个依赖于共同体、依赖于他者的有着内在结构的概念。当代中国权利理论正在走向一个共同体的权利时代。
Since the emergence of the Right-based theory in the late 1980s, the development of contemporary Chinese right theory has undergone more than 30 years, and the development has its own inherent logical progress and reflects the change of the spirit of the times. The Contemporary Chinese right theory was born in the culture atmosphere of advocating individuality in the 1980s, and has receive material support in the development of economy and society from 1978. The rise of the theory of rights in contemporary China is accompanied by the knowledge of subjectivity, and deepened with the growth of this knowledge. From the works of different rights theorists in different periods, we can see the different expressions of subjectivity of right, and that from the concept of expressing individual？？s free choice, right gradually develops into a concept with internal structure which depends on community and others. The contemporary Chinese right theory is moving towards an era of community of rights.
