EFFECTS OF ANKARA AGREEMENT WITHIN THE COMMUNITY LEGAL ORDER

Avrupa Birli inde Türk vatanda lar i in i ilerin serbest dola m ve sosyal güvenlik alanlar nda elde edilen haklar, sürekli geli en bir yasal arka plana sahip olup toplulu un yasal düzeninde nemli bir yer te kil etmektedir. Bu yaz , Türk vatanda lar n n sosyal güvenlik haklar ile i ilerin serbest dola m hakk ndaki temel yasal düzenlemeleri Ankara Anla mas , Katma Protokol ile Ortakl k Konseyinin 1/80 ve 3/80 say l kararlar er evesinde ele alacakt r. Bu al ma, Türk i ilerinin Ortakl k Konseyi kararlar ve Avrupa Adalet Divan n n i tihat hukukundan ileri gelen Avrupa Birli i i indeki g receli iyi konumunu ve bu sayede di er ü üncü ülke vatanda lar ndan farkl durumuna da de inmektedir. Son olarak al ma, Türk i ilerinin imtiyazl olmalar na ra men hala e it muamele ilkesiyle ilgili zülmesi gereken bir ok sorunun oldu unu ne sürmektedir. The achieved rights regarding free movement -of workers- and social security for Turkish citizens in the European Union have a progressive legal background and constitute a major role within the Community legal order. This paper presents the main legal steps related to free movement of workers and social security rights of Turkish citizens in the context of Association Agreements, Ankara Agreement, Additional Protocol and Decisions 1/80 and 3/80 of Association Council. Study also presents the distinctive situation of Turkish workers as per the other third country nationals by illustrating the relatively better position of Turkish workers in European Union is mostly derives from the decisions of Association Council and case laws of the European Court of Justice. Finally study suggests that although Turkish workers are privileged, there are still many issues regarding the principle of equal treatment which have to be solved.
