En este artículo se plantea que la racionalidad moderna se construye sobre la base de distintas racionalidades ensambladas en el modelo de Estado Constitucional de Derecho y que se cimientan en la concepción de los derechos como límites del poder. El principio de proporcionalidad es un reflejo de los equilibrios implícitos en esa concepción y, si bien constituye una propuesta interesante, exhibe ciertas dificultades en su desarrollo actual que comprometen las exigencias de certeza que requiere un test de racionalidad fiable. This paper proposes that the modern rationality depends on the diferents rationalities that compose the rule of law and the liberal conception of the humans rights. The principle of proportionality is a reflection of the balances required by this conception and it is an interesting theoretical proposal. However, the principle of proportionality presents some problems at the present time and therefore it's not possible to consider it as a real test of rationality.
