Abstract:

International law restricts a state’suse of a state of emergency to deprive its populationof certain basic human rights. This article exploresthe application of these restrictions to a non-stateactor -the United Nations - when it assumes the samefunctions of a state while administering territorypursuant to a mission authorized by the SecurityCouncil. The author proposes that they should bemade applicable, by the eventual accession of the UNto the International Convention on Civil and PoliticalRights, and more immediately by the agreement of theUN to abide by the norms set forth in that Convention.
