REFUNDEMOS LA NACIóN: PERDONEMOS A DELINCUENTES POLíTICOS Y COMUNES REFOUND NATION: FORGIVE POLITICAL AND COMMON CRIMINALS

El artículo destaca la existencia en la historia colombiana de siete grandes eventos de perdón en los que se concedieron amnistías e indultos a delincuentes políticos pero también a comunes. Siete coyunturas que sobresalen en medio de más de dos centenares de beneficios jurídicos otorgados en su mayoría a delincuentes políticos a lo largo de la historia de Colombia. Siete coyunturas en que se quebraron los mandatos constitucionales de no otorgar esos beneficios a simples delincuentes comunes ni a delincuentes políticos que hubieran cometido delitos atroces. Esa singular tendencia aparece asociada a cambios constitucionales, a la idea de realizar transformaciones político-sociales y a la intención de refundar de nuevo la nación. A esos perdones se llegó por dos vías: La expedición de normas claras en tal sentido; o llamando a los beneficios por otro nombre o torciéndole el sentido a las reglas. En momentos en que se habla de la terminación del conflicto es importante preguntarnos si no estaremos repitiendo la historia, sin tener en cuenta las lecciones que ella nos ha dejado. The article highlights the existence in Colombian history of seven major events in which forgiveness is granted amnesties and pardons to political offenders but also common. Seven joints that stand in the middle of more than two hundred legal benefits granted to political offenders mostly along the history of Colombia. Seven joints that broke the constitutional mandates of not granting such benefits to simple common criminals and political offenders who have committed heinous crimes. This trend is associated singular constitutional changes, to the idea of -social and political transformations intended to refound the nation again. To those pardons were reached in two ways: The issuance of clear rules in this regard, or by calling the benefits by another name or twisting the meaning of the rules. At a time when we talk about the end of the conflict is important to ask whether we are repeating history, regardless of the lessons she has left us.
