EL CAMBIO CONSTITUCIONAL FACTOR DE DEMOCRATIZACIóN? CONSTITUTIONAL CHANGE FACTOR DEMOCRATIZATION?

Este artículo propone una reflexión orientada a cuestionar un supuesto muy difundido entre los actores sociales y los gobiernos, quienes comulgan en torno a un aparente consenso: el cambio constitucional es un factor de democratización. El texto inicia por recordar las principales aristas del debate alrededor del cambio constitucional, especialmente su asociación con el tema de la democracia y la refundación. Luego analiza la relación entre mecanismos de cambio constitucional y procedimientos democráticos del cambio político. Por último profundiza en el cuestionamiento de la relación entre cambio constitucional y democracia al examinar el tema de la representación y participación en las asambleas constituyentes de Colombia (1991), Venezuela (1999), Ecuador (1998 y 2007-2008) y Bolivia (2006-2008). This article proposes a reflection aimed at challenging a widespread assumption among social partners and governments around communicants apparent consensus: the constitutional change is a factor of democratization. The text begins by recalling the main aspects of the debate about constitutional change, especially its association with the issue of democracy and the new foundation. It then analyzes the relationship between mechanisms of constitutional change and democratic processes of political change. Finally explores the question of the relationship between constitutional change and democracy to examine the issue of representation and participation in the constituent assemblies of Colombia (1991), Venezuela (1999), Ecuador (1998 and 2007-2008) and Bolivia (2006 -2008).
