Resumo: O objetivo deste trabalho é confrontar duas concep es política e jurídica da modernidade. Por um lado, o constitucionalismo trabalha com a mitifica o da Constitui o operando uma economia de violência juridicamente sancionada. Por outro lado, a democracia nutre-se de uma promessa que nunca chega ou satisfaz e, ao mesmo tempo, sofre ataques constantes daqueles mesmos que a exaltam. Aliado a Benjamin e a Derrida, prop e-se uma crítica às bases postuladas pelo constitucionalismo sob o signo da Constitui o. A condi o para que a Democracia sobrevenha resta sobre a experiência do impossível, deslocando os horizontes e estruturas constitucionais. Palavras-chave: Democracia; Constitui o; Desconstru o; Violência. Abstract: The aim of this work is to confront two political and legal conceptions of modernity. On one hand, constitutionalism works with the mythification of the Constitution which operates an economy of violence legally sanctioned. On the other hand, democracy is fed on a promise that never comes enough or satisfies and, at the same time, suffers constant attacks of those who glorify it. Allied to Benjamin and Derrida, it propose a critique of the bases postulated by constitutionalism under the sign of the Constitution. The condition to Democracy overcomes remains on the experience of the impossible, shifting constitutional horizons and structures. Key-words: Democracy; Constitution; Deconstruction; Violence
