Resumo O presente trabalho tem como objeto a análise da justificativa das decis es judiciais que aparentemente s o contra legem. A hipótese levantada no presente trabalho é que é possível analisar a corre o das decis es judiciais, mesmo quando elas aparentemente contrariam o texto da lei. O marco teórico utilizado foi a teoria da argumenta o jurídica que é capaz de aferir a corre o das decis es judiciais, tantos nos casos claros, quanto nos casos difíceis, permitindo inclusive eventuais decis es, que fujam da significa o aparentemente mais óbvia da lei, sejam consideradas corretas, quando fundamentadas em princípios ou nas consequências. Palavras-chave: Argumenta o Jurídica; Princípios; Consequências. Abstract This paper focuses the analysis of the justification of judicial decisions that are seemingly contra legem. The hypothesis in this study is that it is possible to analyze the correctness of judicial decisions, even when they seemingly contradict the text of the law. The theoretical framework used was the theory of legal reasoning that is able to assess the correctness of judicial decisions, so in clear cases, as in hard cases, even allowing any decisions, that flee the seemingly most obvious meaning of the law, are considered correct, when based on principles or the consequences.
