Abstract The history of the XX and XXI centuries shows that the return of the law and the state, associated with the recognition and protection of human rights, represents a qualitative change in legal and political systems. The rights are neither a reflection of past historical reproduction cycles nor the deduction of the human rights of political constitutions.
