La sociedad anónima en la tradición jurídica hispano-indiana Joint-Stock Companies in the Spanish Legal Tradition in the Indias

El artículo aborda los orígenes de las sociedades anónimas en la tradición jurídica hispánica y su desarrollo a partir del siglo XV con la "avería" en el mundo indiano. Se estudia su progresivo desarrollo y transformaciones y se les compara con las grandes compa ías y sociedades creadas paralelamente en otras tradiciones jurídicas. El estudio concluye con la reglamentación de las sociedades anónimas en el Derecho republicano anterior a codificación. This article addresses the origin of joint stock companies within the Hispanic legal tradition and its development as of the XV Century with the "avería" in the world of the Indies. Its progressive development and transformations are studied and they are compared to the large companies and societies simultaneously formed within other legal traditions. We conclude this analysis with the regulation of the joint stock companies in the republican Law before the codes were written.
