GENERAL CLAUSE OF STRICT CIVIL LIABILITY IN CIVIL CODE A CLáUSULA GERAL DE RESPONSABILIDADE CIVIL OBJETIVA NO CóDIGO CIVIL

This paper aims to outline the institute's objective liability, with an emphasis on accountability clause general objective founded in Risk Theory, entered in Civil Codex of 2002. For this we will make a brief presentation on the evolution of the institute, through the rule of responsibility with guilt, until we get to the scene we know today, looking better understand it. O presente trabalho visa delinear o instituto da responsabilidade civil objetiva, com ênfase na cláusula geral de responsabiliza o objetiva fundada na Teoria do Risco, inserida no Codex Civil de 2002. Para isso, far-se-á uma breve exposi o sobre a evolu o do instituto, passando pelo império da responsabilidade com culpa, até chegarmos ao cenário que hoje conhecemos, procurando melhor entendê-lo.
