State's Civil Responsibility and the Process Delay Responsabilidade Civil do Estado e a Morosidade Processual

The article discusses the evolution of the State's civil responsibility since the Republican Constitution of 1891 until nowadays, analysing it's developments in face of the phenomenom of Process Delay, proposing a new interpretation of the old instruments already included in the Civil Process Code (The Mandado de Seguran a Injunction and the Indemnification Popular Action) to solve the conflicts between the length of a process and the damages it causes to the society, O texto aborda a evolu o do instituto da responsabilidade civil do Estado desde a Constitui o Republicana de 1891 até os dias atuais, analisando seus desdobramentos diante do fen meno da morosidade processual, propondo uma nova interpreta o de instrumentos já consagrados no Código de Processo Civil (Mandado de Seguran a, A o Popular e Indenizatória) para resolver o conflito temporal do processo e os danos que acarreta à sociedade.
