This paper aims to discuss the improving demand from the indemnification actions in Brazilian Judiciary, having as consequence the over-generalization of the moral damages and slowing the Judiciary. In this sense, the criteria for arbitrating the value of the indemnification demands proposed by our superior courts with ends to compel the over-generalization of the indemnifiable quantum, basing in studies of the doctrine and jurisprudence. O presente artigo visa discutir a crescente demanda de a es indenizatórias no Judiciário brasileiro, tendo como conseqüência principal a banaliza o do dano moral e a morosidade da justi a. Nesse sentido analisaremos os critérios de fixa o de valor das demandas indenizatórias propostas pelos Tribunais Superiores a fim de compelir a banaliza o do quantum indenizável, baseando os estudos na doutrina e jurisprudência atual.
