Una justícia pròxima i efica des de les comunitats autònomes: La introducció del ‘Rechtspfleger’ alemany

This paper explores the possibility for the provisions of the Government ofCatalonia to contribute to a closer and more effective practice of justice,despite the limitations of competence derived from the constitutional andstatutory frameworks. The paper begins with an approach to the concept oflocal justice and its models, and relates them to the positive concept of justiceefficiency and corresponding measuring criteria introduced by EU. Then followsthe description of the German Rechtspfleger, an institution almost completelyunheard-of in our country, which settled 80% of the procedures inthe German courts of first instance and which has been the key for efficiencypromotion in the German courts. The paper closes with two questions:a) to what extent would such an officer fit our justice administration?, andb) which role should Catalonia play in the development of the new statutoryframework after the passing of Sentence no. 31/2010, June 28, by theConstitutional Court, so as to achieve a more efficient practice of justice?
