Abstract:

Constitutional Court Ruling 31/2010, of 28 June, up holds the constitutionality of all articles of the Statute concerning language, except for the “preferential” reference in article 6.1. Despite this, as conditioning factors of constitutionality,the Court has brought into the ruling some points of legal reasoning which, without any in-depth study of the Catalan situation to any solid legal reasoning, on the basis of ideological prejudices, have tended to dilute the obligation to speak and understand Catalan, and the fact that it ought to be the only communication and learning language in the education system, and that it may be used as the communication language by the Catalan Government. This article high lights some inconsistencies in the ruling and links the “reinterpreted” articles to those that have not, thus enabling to draw an interpretation which sustains that there is no need to amend any Catalan regulation and that, on the contrary, calls for a change in certain of the current Central Government rulings that restrict freedom of choice in language.
