CRITICAL CONSIDERATIONS ON THE QUANTIFICATION OF THE LOSS OF A POSSIBILITY TO THE LIGHT OF THE CASUISTRY

: Objective, by means of the developed article, to weave evaluations onthe criteria of quantification of the loss of an opportunity through the study ofconcrete cases. For in such a way, it is analyzed theory pondering itself cases withexcellent legal repercussion, such as of the “Show of the Million”, of the“imperfection in the rendering of services for the post offices” and of the“depreciation of the actions”. The theory of the loss of a chance will be analyzed, inthis study, as one of the forms of obligatory breach of contract. It is aimed at todemonstrate that the loss of an opportunity must medium be indemnified with theuse of reasonable and objective standards and not only to be compensated.
