Gaza and debate on genocideKeywords: Gaza , Palestine , Israel , Genocide , ICC Abstract: Israeli assault between December 27, 2008 and January 18, 2009 on Gaza, which has been transformed into an open air prison because of the siege almost for the last two years, has turned the life in the city into a tragedy. Taking into account that actions committed with the aim of destroying in whole or in part a national, ethnic, racial or religious group are defined as ‘‘genocidal crimes’’, it is possible to evaluate the current situation in Gaza within this context. In this essay, it is debated that whether what is happening in Gaza is able to be evaluated as genocide or commit to genocide according to the provisions of the Rome Statute and it is argued that Gaza case will be an important test for the future of International Criminal Court and for the prevention of crimes against humanity.
