LA SUSTITUCIóN DE PENA EN EL DERECHO PENAL JUVENIL CHILENO THE SUSTITUTION OF THE SENTENCE IN THE CHILEAN JUVENILE JUSTICE

El instituto de la sustitución de pena contemplado en los artículos 53 y 54 de la Ley de responsabilidad penal adolescente es novedoso en nuestro derecho y clave para el cumplimiento de la sanción juvenil. Pese a su relevancia ha sido objeto de escasa atención. El presente trabajo encuadra esta institución en el derecho internacional de los derechos humanos, y, enseguida, revisa su regulación en el derecho penal juvenil comparado. Analiza la regulación normativa con las numerosas aristas que la práctica ha dejado al descubierto y considera la jurisprudencia más relevante al respecto ofreciendo criterios a considerar en las audiencias en que se debata la sustitución. The Institute of substitution of sentence provided in articles 53 and 54 of the Juvenile Criminal responsibility Law is new to our system and key to the fulfillment of the juvenile sanction. Despite its significance, it has received little attention. This work fits this institution in the International Law of human rights and reviews its regulation in several countries. It analyze the legislation according the numerous edges that practice has exposed, and it considers the relevant case law, providing criteria to be considered at the hearings where the substitution is discussed.
