EXPROPIACIóN INDIRECTA POR MEDIDAS CAUTELARES EN PROCEDIMIENTO TRIBUTARIO INDIRECT EXPROPRIATION FOR PRECAUTIONARY MEASURES IN A TAX PROCEDURE

El presente artículo tiene por finalidad comentar un laudo dictado recientemente por un panel arbitral al amparo del Centro Internacional de Arreglo de Diferencias Relativas a Inversiones. Dicho fallo da cuenta del estado de la situación en materia de expropiación indirecta de inversiones extranjeras, enumerando una serie de criterios que comúnmente se ha utilizado para discernir cuándo se trata de un caso de ejercicio legítimo de los poderes de policía de los Estados, que permiten proteger sus intereses esenciales; o de una situación en que surge la responsabilidad del Estado por la conducta de sus entes regulatorios. Los parámetros analizados para determinar la responsabilidad del Estado por haber adoptado medidas que equivalen a la expropiación son: (i) la gravedad de las consecuencias; (ii) la extensión de los efectos; (iii) el carácter de las medidas; y (iv) la eficacia de las mismas. The present article’s purpose is to comment an arbitral award that has been recently dictated by a panel constituted under the International Centre for the Settlement of Investment Disputes, which reflects the present state of art in the subject of indirect expropriation of foreign investment. The ruling deals with the commonly used criteria to distinguish the legitimate exercise of State’s police powers, that allows it to protect its essential interests; from other situations that gives raise to the State’s responsibility for the conduct of its regulatory organs. The criteria analyzed to determine the responsibility of the State for having adopted measures tantamount to expropriation are: (i) the gravity of the consequences; (ii) the extension of its effects; (iii) the character of the measures; and (iv) its effectiveness.
