EL USO DEL DERECHO CONVENCIONAL INTERNACIONAL DE LOS DERECHOS HUMANOS EN LA JURISPRUDENCIA DEL TRIBUNAL CONSTITUCIONAL CHILENO EN EL PERíODO 2006-2010 THE USE OF INTERNATIONAL TREATY LAW OF HUMAN RIGHTS IN THE JURISPRUDENCE OF THE CONSTITUTIONAL COURT OF CHILE IN THE PERIOD 2006-2010

El presente estudio analiza cómo el Tribunal Constitucional en el último quinquenio ha asumido el derecho internacional de los derechos humanos en un contexto de un constitucionalismo que afronta los derechos como un sistema único de fuente constitucional y de fuente internacional, a partir de la afirmación de estos como derivaciones de la dignidad humana. El centro del análisis se encuentra en la consideración de si los derechos humanos asegurados por vía convencional internacional forman o no parte de un bloque de constitucionalidad y si ellos son utilizados como canon o parámetro de control de constitucionalidad de normas infraconstitucionales, todo ello de acuerdo a la jurisprudencia del Tribunal Constitucional del periodo analizado. The study analyses how the Constitutional Court in the last five years has taken on the international law of human rights in the context of constitutionalism facing rights as a single international source, since the assertion of these as derivations of human dignity and constitutional source. The analysis standpoint is located in the consideration of whether human rights secured by international conventional route form or not part of a block of constitutionality and if they are used as canon or control of constitutionality for under constitutional norms, everything according to the jurisprudence of the Constitutional Court in the analyzed period.
