REALMENTE IMPORTA LA SANA CRíTICA? IT REALLY MATTER SOUND CRITICISM?

Este texto propone una forma de comprender la sana crítica que permite sortear parte importante de los problemas de indeterminación asociados a dicha locución. Luego de analizar las funciones de los sistemas de valoración de la prueba y de revisar definiciones sugeridas en distintos textos respecto de la sana crítica, se plantea que lo que realmente está en juego es una cierta manera de distribuir responsabilidades por la elección de ciertas reglas de validación de 'hechos'. En el caso de la sana crítica, dicha responsabilidad se hace recaer sobre quienes profesan disciplinas prestigiosas en la construcción de conocimientos o, en su defecto, en todos aquellos que pertenecen a la comunidad (la misma del juez) en la que se ha consolidado una cierta forma de comprensión común de la realidad . Al concebir la sana crítica de esta manera, en principio, se hace posible controlar las decisiones judiciales. This paper proposes a way of understanding sound criticism that avoids an important part of the problems of vagueness associated to this expression. After analyzing the functions of the systems for weighing evidence and revising the definitions of sound criticism suggested in different texts, the conclusion is that what really is at stake it's a certain way of distributing responsibilities for choosing the rules to validate ‘facts'. In the case of sound criticism, that responsibility falls in those who practice a prestigious discipline in the construction of knowledge or in all those that belong to the community (the same community of the judge), that share a common comprehension of reality . When conceiving sound criticism in this way it turns possible, in principle, to control judicial decisions.
