MOVILIZACIONES ESTUDIANTILES Y EL DERECHO DE LOS ESTUDIANTES A LA LIBERTAD DE EXPRESIóN COMO LíMITE A LA LIBERTAD DE ENSE ANZA STUDENT DEMONSTRATIONS AND THE STUDENTS' RIGHT TO FREEDOM OF SPEECH AS A LIMIT TO FREEDOM OF EDUCATION

El presente estudio analiza un grupo de sentencias en materia de recursos de protección interpuestos por estudiantes invocando la violación de diferentes garantías constitucionales -entre ellas, la libertad de expresión-, luego de haber participado en movilizaciones estudiantiles. El autor expone cómo la jurisprudencia reconoce el derecho de expresión de los estudiantes, y cómo este reconocimiento impone un límite a la libertad de ense anza. This paper analyzes a group of leading cases in matters of action for protection brought by students alleging the violation of several constitutional guarantees -including freedom of speech-, after having participated in student demonstrations. The author shows how the jurisprudence recognizes the right of speech of the students, and how this recognition implies a limit to the freedom of education.
