Tratamiento penitenciario en la provincia de Buenos Aires . El desafío de ajustar la legislación a la práctica internacional

The penitentiary treatment in the province of Buenos Aires (Argentina), is regulatedby the law 12.256 in generic form. This norm does not make any differenceamong the general conditions to guarantee the feasibility of the penitentiarytreatment and the objectives and reaches of the treatment itself. Differentiatingthe three aspects of the penitentiary function that is, the penitentiary treatment,the penitentiary attendance, and the preservation of rights of people in jail,the purpose here is to analyze the current instruments which establishes thelegislation and consequently to pose possible adjustments to international norms.The necessity for modifications which allow defining the intervention object, todelineate the objectives and their reaches, to determine the base conditions ofthe intervention and to guarantee long term evaluations, correcting in this waythe structural myopia of the penitentiary institutional program, is deduced froma compared analysis.
