A Study of Contractual Autonomy and Supervision

The principle of contractual autonomy of the People's Republic of China will greatly affect the contract's supervision. By giving a brief account of the theory and content of the principle of contractual autonomy and the viewpoint, scope and method of supervision of contracts, this article intends to emphasize that we shall guide contract's supervision through the principle of contractual autonomy; confirm and protect the lawful rights of parties of contracts; adjust the interests of each party by using the rule of restriction on contractual autonomy. The legislation of contract's supervision must benefit the realization of contractual autonomy.
