The Proportion Principle of EU Law and German Law
|
Abstract:
The proportion principle whose aim is to prevent excessively breaking the equilibrium of interest and value is a core principle of the constitution and administration law. It can be also partly applied in the private law. After studying the relationship between goal and means, it should be stressed that, by reaching the goal, the basic proprietary and human rights shouldn't be hurt excessively. This is important for our reference and absorption.
