In the progress of the modernization of pharmaceutical industry in traditional Chinese medicine, the system of intellectual property has its important functions of protecting medicinal resources, advancing research level and promoting and guaranteeing the industrial scale of traditional Chinese medicine, one of the key factors for the guarantee and promotion of the modernization of traditional Chinese medicine. At present in China there exists superiosity in the number of applications for intellectual property right in traditional Chinese medicine, but their technical contents are not satisfactory. In the field of traditional Chinese medicine the idea of intellectual property right must be reinforced as a whole and the work level in intellectual property right be raised as quick as possible so as to meet the demand for the modernization of traditional Chinese medicine and for its international competition when China accedes WTO.
