Abstract: in the present article i argue that john rawls does not succeed in developing "justice as fairness" as a political conception of justice. rawls's adoption of t. m. scanlon's principle of moral motivation is incompatible with the basic theses of his theory of political justification. now, i understand that rawls must ground "justice as fairness" with a principle such as scanlon's both for conceptual reasons as well as for reasons internal to the theory of political justification. therefore, i believe rawls cannot weaken his commitment to this principle. this fact makes rawls's theory untenable as it stands.
