this research analyzes the requirement of subjective identity of the non bis in idem principle. this way the implications resulting from this element, the existing legal vacuums concerning the consequences the observance of this postulate and finally, an interpretation is presented, that to our knowledge maight help to solve the existing legal vacuum.
