Abstract:

近几年,电子商务的蓬勃发展也带来了网购二手商品市场的繁荣。消费者在享受网购二手商品便捷性的同时,在行使反悔权时也面临着诸多风险与挑战。首先通过深入探究网购二手商品消费者反悔权的现存困境,发现目前存在着涵盖法律法规不完善、平台规则不合理与监管不力、消费者与商家层面的矛盾冲突等。由此进一步分析影响反悔权行使的因素,如商品信息、物流配送与售后服务、消费者认知与维权意识等。最后提出完善路径,包括细化法律法规以明确标准与责任,优化平台规则并强化监管与纠纷调解,提升消费者与商家素质以促进理性交易与诚信经营等,旨在构建合理的反悔权制度,推动网购二手商品市场健康发展并实现消费者权益与市场繁荣的双赢。
In recent years, the booming development of e-commerce has also brought prosperity to the online second-hand goods market. While consumers enjoy the convenience of online shopping for second-hand goods, they also face many risks and challenges when exercising their right to retract. Firstly, by delving into the existing challenges of consumers’ right to retract their purchase of second-hand goods through online shopping, it was found that there are currently incomplete laws and regulations, unreasonable platform rules and inadequate supervision, and conflicts between consumers and merchants. Further, this paper analyzes the factors that affect the exercise of the right to retract, such as product information, logistics distribution and after-sales service, consumer awareness and awareness of rights protection. Finally, a path for improvement is proposed, including refining laws and regulations to clarify standards and responsibilities, optimizing platform rules and strengthening supervision and dispute resolution, enhancing the quality of consumers and merchants to promote rational transactions and honest management, etc. The aim is to establish a reasonable system of the right to retract, promote the healthy development of the online shopping second-hand goods market, and achieve a win-win situation between consumer rights and market prosperity.
