婚姻中“恶意第三者”侵权责任探析

“婚姻者，合二姓之好。”然而，随着时代的发展，人们的爱情观及婚姻观发生了改变，“婚外情”“包二奶”等不正当男女关系层出不穷，甚至变本加厉，威胁社会的安定。通过对“恶意第三者”侵权进行法理分析，强调“恶意”对追究其侵权责任的可行性和必要性，并基于我国相关现状及存在的配偶权缺失，侵权责任主体有限，法律救济不明确和举证、取证不健全等问题，明晰该侵权责任的特殊构成要件，提出“实体法 + 程序法”双层面具体完善路径，维护无过错方配偶的合法权益，为家庭和谐与社会稳定贡献法律力量。
The stability of marriage and family plays a pivotal role in social development. Nevertheless, with the rapid development of social economy as well as the change of times, illicit sexual relationships emerge one after another. Moreover, the harmony of society has been threatened. As a consequence, clarifying the definition of “malicious third parties”, it emphasizes “malicious” to pursue the feasibility and necessity of tort liability. In the meantime, combined with the legislation status of homeland, analyzing the constituent elements of tort liability and proposing “substantive law + procedural law” specific improvement paths to safeguard the legitimate rights and interests of non-fault spouses. For the sake of contributing legal power to family harmony and social stability.
