检察官的客观公正义务
The Prosecutor’s Duty of Objectivity and Impartiality

我国的检察机关作为法律监督机关在我国的刑事诉讼活动中发挥着重要的作用，其中作为法律捍卫者的检察官以及其天生所应当具有的客观公正义务这一至关重要的属性，对于我国可能发生的假案、错案具有非常现实有效的防范、规避功能。通过借鉴中西方行之有效的社会实践，本文主要从检察官客观公正义务的六大要求入手，详细探讨客观公正义务的内涵与内容，并以此为基础，对比我国的立法现状与司法实践，从而得出让检察官更好地履行其客观公正义务的完善措施，从而有效避免冤假错案的发生。
The procuratorial organs in our country play an important role as legal supervision organs in criminal litigation activities. Among them, as the defenders of the law, prosecutors and their essential attribute of objective and impartial obligations have a very practical and effective prevention and avoidance function for possible false and erroneous cases in our country. By drawing on effective social practices in both the East and the West, this article mainly starts with the six requirements of the objective and impartial obligations of prosecutors, explores in detail the connotation and content of the objective and impartial obligations, and based on this, compares the legislative status and judicial practice in China, in order to obtain comprehensive measures for prosecutors to better fulfill their objective and impartial obligations, and effectively avoid the occurrence of wrongful cases.
