社区养老服务的法律保障问题研究
Research on the Legal Protection of Community Elderly Care Services

随着老龄化问题的加重，养老问题也备受关注。目前，由于社区服务的方便、灵活、覆盖范围广等特点，社区养老已成为国家养老体系的重要组成部分。然而，当前现实显示，社区养老还存在着市场混乱、相应的法律制度未得到完善等问题，这在一定程度上也影响了社区养老服务的提升和发展。针对这一情况，本文首先分析了我国社区养老服务法律制度的现状和存在的问题，然后以相关经验为启示进行探讨，最后提出通过完善相关法律法规、强化资金保障等对策来有效应对这一问题，以完善我国社区养老服务制度的框架。
With the aging problem becoming more serious, the issue of elderly care is also receiving increased attention. Currently, due to the convenient, flexible, and widespread coverage of community services, community-based elderly care has become an important part of the national elderly care system. However, the current reality shows that community-based elderly care still faces problems such as market chaos and the lack of corresponding legal systems, which to some extent also affect the improvement and development of community-based elderly care services. In response to this situation, this paper first analyzes the current status and problems of the legal system for community-based elderly care in China, then draws on relevant experience for discussion, and finally proposes countermeasures such as improving relevant laws and regulations and strengthening financial support to effectively address this issue and improve the framework of China’s community-based elderly care system.
