医疗大数据安全法治与监管

Abstract:
当前人工智能与医疗健康深度融合,作为智能医疗根基的医疗数据得到各界广泛关注。一方面,医疗数据所涉甚广,一旦数据系统瘫痪,数据被损害或泄露将会对个人隐私权、基因安全、国家安全等领域产生极大威胁;另一方面,医疗数据具有极大开发潜力,然而当前数据处理与共享监管缺位,开发利用程度低,数据资源极大浪费,因此加快医疗数据安全法治与监管迫在眉睫。本文结合当下医疗大数据应用的实际情况,剖析医疗大数据的现实应用困境,并从法律法规完善、风险意识培育、监管机构建立、共享平台建设等角度提出优化策略,以求实现对医疗大数据安全的法治建设与有力监管,从而畅通医疗数据共享,推动我国医疗卫生事业现代化进程。
At present, artificial intelligence and medical health are deeply integrated, and medical data, as the foundation of intelligent medical care, has received wide attention from all walks of life. On the one hand, medical data is widely involved. Once the data system breaks down, data damage or disclosure will pose a great threat to personal privacy, genetic security, national security and other fields. On the other hand, medical data has great development potential, but the current data processing and sharing supervision is absent, the development and utilization degree is low, and the data resources are greatly wasted. Therefore, it is urgent to accelerate the rule of law and supervision of medical data security. Based on the current actual situation of medical big data application, this paper analyzes the practical application difficulties of medical big data, and proposes optimization strategies from the perspectives of improving laws and regulations, cultivating risk awareness, establishing regulatory agencies, and building sharing platforms, to realize the rule of law construction and strong supervision of medical big data security, to smooth the sharing of medical data. Promoting the modernization of medical and health undertakings.
