新增复议前置情形争议之讨论
Added Discussion of the Dispute over the Preconditions of Reconsideration

《行政复议法》于2023年全新修订，其中最重要的修改之一为扩大了复议前置范围，由《行政复议法》直接新增三种复议前置情形，分别为当场作出的行政处罚决定、行政不作为案件、不予公开政府信息案件。本文针对当场作出的行政处罚、行政不作为案件这两种新增情形所产生的争议进行探讨，以明确该两种复议前置情形的外延。针对不予公开政府信息案件，由于在字面理解上不产生相关争议，且其余政府信息公开相关行为会在行政不作为案件的外延讨论中涉及，故本文不作相关探讨。
The “Administrative Review Law” was newly revised in 2023, one of the most important amendments is to expand the scope of reconsideration advance, and directly add three reconsideration advance circumstances from the “Administrative Review Law”, respectively, administrative punishment decisions made on the spot, administrative inaction cases, and cases of not disclosing government information. This paper discusses the disputes arising from the two new cases of administrative punishment and administrative omission on the spot, in order to clarify the extension of these two cases. As for the case of non-disclosure of government information, because there is no relevant dispute in literal understanding, and other related acts of disclosure of government information will be involved in the extended discussion of administrative inaction cases, this paper will not discuss the relevant.
