大数据赋能新时代法律监督的审视和反思
Examination and Reflection on Legal Supervision Empowered by Big Data in the New Era

大数据赋能新时代法律监督是当前检察机关的首要任务，通过对两届全国检察机关大数据法律监督模型竞赛数据的研究，实地考察模型创意来源、数据获取、监督点位、基本原理、建构逻辑、应用领域、社会效果，发现存在监督点位不准、规范性不足、有效性不强、机制制度不健全等薄弱环节，提出加强顶层设计，出台办案规则，厘清边界；建立数据平台，规范数据；人员机制构建，提高有效性，以大数据赋能新时代法律监督，满足人民群众在新时代对法治、公平、正义、安全等方面新的更高要求。
Empowering legal supervision in the new era with big data is currently the primary task of the procuratorial organs. Through the study of the data from the two National Big Data Legal Supervision Model Competitions for Procuratorial Organs, we conducted on-site investigations on the creative sources, data acquisition, supervision points, basic principles, construction logic, application areas, and social effects of the models. We found that there are weak links such as inaccurate supervision points, insufficient standardization, weak effectiveness, and incomplete mechanisms and systems, propose to strengthen top-level design, introduce case handling rules, and clarify boundaries. We establish a data platform and standardize data, build personnel mechanisms, improve effectiveness, and achieve a doubling effect of big data empowering legal supervision in the new era, to meet the new and higher requirements of the people for the rule of law, fairness, justice, security, and other aspects in the new era.
