“放管服”背景下通用航空市场监管法律制度的重构研究

通用航空法规体系的重构工作在近年来取得了进展，在一系列法律规范颁布的过程中通用航空市场监管法律制度也初具雏形。文章在梳理通用航空业务分类和市场准入制度的重构历程的基础上，发现在“放管服”的背景下当前通用航空市场监管法律制度的重构仍存在放权不彻底、监管不科学、服务不到位的问题。因此有必要立足于当下通用航空的发展，关注新兴业态，对通用航空市场监管法律制度的重构进行完善。
The restructuring of the general aviation regulatory system has made progress in recent years, and the legal system for the regulation of the general aviation market has also taken shape in the process of promulgating a series of legal norms. Based on the reconstruction process of general aviation business classification and market access system, this paper finds that there are still problems of incomplete decentralization, unscientific supervision and inadequate service in the reconstruction of the legal system of general aviation market regulation under the background of “release, management and service”. Therefore, it is necessary to improve the restructuring of the legal system of general aviation market regulation based on the current development of general aviation, focusing on the new industry.
